The defendants charged in a case involving the abduction of an individual, who was subsequently forced to sell drugs and had a finger severed, have been found guilty.

This case involves the unlawful detention of an individual at a residence in Malé between May 25, 2024, and June 25, 2024. The victim was allegedly held against their will, intimidated, and coerced into participating in the drug trade. During this period, the victim was subjected to severe physical assault and torture, which resulted in the amputation of their left pinky finger.

The victim in this case is a 30-year-old Maldivian man.

The state has pressed charges against five individuals in connection with this case. The defendants are Ali Samee of Mehra, R. Kandholhudhoo; Ahmed Saif Waheed of Huduveli, GDh. Gadhdhoo; and Mohamed Naushan Hussain of Uthuruge-aage, Th. Thimarafushi. The remaining two suspects are MNDF officers: Mohamed Nafah of Full Moon, K. Maafushi, and Ahmed Zayan of Thundi/Link, L. Gan.

Three minors under the age of 18 were also involved in this case.

During the trial, the prosecution detailed the extent of the torture inflicted by the defendants. This included withholding assistance from a person in need without justification and severing a finger using a power tool. The victim also sustained injuries from an assault to the left eye, and the body showed visible signs of physical abuse and cigarette burns or branding across various areas.

In this case, Saif was found guilty of assault using a sharp object causing grievous bodily harm and was sentenced to 15 years in prison. Meanwhile, Sami and Naushan were convicted of aiding and abetting the assault and were each sentenced to 10 years imprisonment.

Nafah was also charged with participating in an assault using a sharp object that resulted in the loss of a limb. However, he was not found guilty of the charge.

Furthermore, although Zayan was found guilty of failing to provide assistance to a person in need without a valid reason, the prescribed penalty for this offense is a three-month prison sentence. Since the duration he has already spent in custody exceeds this term, there is no remaining sentence for him to serve.

Supreme Court rules High Court was correct to exclude state's new evidence in Aarah case

The state has appealed to the Supreme Court following the High Court's decision to reject new evidence submitted in the V. Aarash case, arguing that these materials are crucial to proving falsehoods in defense testimony and that their exclusion would obstruct justice. While the defense has objected, maintaining that introducing new evidence at this stage violates established legal procedures, the criminal trial remains suspended pending a final ruling from the Supreme Court.
