Former Member of Parliament for the Kendhoo constituency and legal expert Ali Hussain has stated that while the Constitution serves as the true ultimate authority in the Maldives' presidential system, President Dr. Mohamed Muizzu has effectively "decapitated" that authority through the Supreme Court.
Speaking on RaajjeTV’s "Fala Surukhee" program, Ali Hussain stated that the Constitution of the Maldives establishes the separation of state powers into three distinct branches. He further noted that the Constitution mandates independent institutions to oversee these branches and defines the specific boundaries regarding the extent of influence one branch may exert over another.
Therefore, he stated that the true guardian of the state is the Constitution.
Therefore, in reality, the ultimate authority in the Maldives is no longer a specific President. Nor is it the Chief Justice, or the Speaker of the People’s Majlis. The true guardian of the Maldives is the Constitution. Thus, as I have stated, the head of this authority has been severed. The Constitution has been decapitated.Attorney Ali Hussain
Referring to President Muizzu, Ali Hussain stated that the President has effectively decapitated the Constitution through the Supreme Court. He further asserted that since the Constitution has been brought to such a state, it is now up to the people to decide on the matter.
Furthermore, Ali Hussain stated his belief that if a presidential election is held in 2028 and citizens are able to cast their ballots at polling stations, the public will deliver a decisive verdict. He asserted that the people will not grant this administration a second term or another opportunity to lead.
However, Ali Hussain cautioned that the current administration might resort to any means necessary to secure a second term, stressing that the public must remain highly vigilant regarding the upcoming presidential election.
