Two suspects arrested under a drug operation, with three kilograms of suspected narcotics, have been released.
They, a 25-year-old man and 52-year-old woman, were arrested at around 3:10am on Tuesday, in a raid conducted at a house in the capital’s suburban district Hulhumalé. Police noted that the raid was conducted under a court order.
However, both were released by the Criminal Court after being presented for a remand hearing.
"Incomplete court orders"
Media official at the Department of Judicial Administration (DJA)), Faisal Adam told RaajjeMV that that Hulhumalé Court orders violated Articles 32 (a) and 41 (b) of the Criminal Procedure Act.
Article 32 (a) states that the signature of the judge authorizing a raid must be on an order, as well as the court stamp. Article 41 (b) states that the signature of the judge authorizing an arrest must be on an order, as well as the court stamp.
Hence, the court stated that both suspects were released as the orders were incomplete.
