High Court refusing to interfere in remand concerning lower court proceeding

The presiding judges expressed their opinion that involving itself in the matter would be an obstruction of the appeal process

The High Court of the Maldives has refused to involve itself in the matter of remand concerning an individual involved in proceedings ongoing at a lower court.

In the hearing for a case filed with the High Court, the presiding judges expressed their opinion that involving itself in the matter would be an obstruction of the appeal process.

The case in question involves an individual who was released from remand by the Criminal Court, a decision appealed at the High Court by the Prosecutor General’s Office.

The High Court judges said on Thursday that such interference is only warranted under specific circumstances, otherwise such involvement is undue influence.

In this regard, the judges decided that the lower courts must decide on the remand sentence of a person involved in a matter currently being heard before them.

The High Court judges presiding over the matter were Judge Ali Sameer and Jude Mohamed Niyaz.
