Asset Recovery Law Unenforceable in Current Form: Shamheed

Dr. Ahmed Shamheed, the Member of Parliament for the South Hulhumale' constituency, has stated that the proposed Asset Recovery Bill is unlikely to be an enforceable piece of legislation.
Debating the bill during Wednesday's parliamentary sitting, Dr. Shamheed stated that the legal definitions within the legislation are overly broad, leading him to believe the law may be unenforceable.
In his remarks regarding the bill, Dr. Shamheed emphasized that the legislation must function within a robust legal framework. He further noted that the formulation of such a law should align with established international standards.
However, he noted that there are several aspects of this bill that require further consideration. In this regard, he highlighted that one of the most significant challenges facing the Maldives is the misuse of laws for purposes other than their intended legislative intent.
He noted that while the bill includes money laundering offenses, the current framework in the Maldives does not align with international standards.
This bill was introduced to Parliament on behalf of the government.
Members of the MDP have emphasized that while it is crucial to draft laws in line with international standards to prevent crime and seize criminal assets in the Maldives, such legislation must be formulated in a manner that ensures it cannot be misused.
