Legal experts had raised questions over the legality of his appointment on November 17

President Ibrahim Mohamed Solih has submitted Imran Abdulla’s name to parliament, for approval as Home Minister.

The Adhaalath Party leader’s name was resubmitted to parliament during Monday’s sitting, and forwarded to the Committee on Oversight of the Government.

While Imran was first appointed to the post on November 17, he resigned on Sunday morning. President Solih reappointed him later in the day.

When he was first appointed, Supreme Court was yet to conclude reviewing Imran’s 12-year imprisonment on terror charges. The court overturned his conviction on November 22.

Article 130 (b) of the Constitution, states that a person who “has been convicted of a criminal offence and sentenced to a term of more than 12 months, unless a period of three years has elapsed since his release, or pardon for the offence for which he was sentenced” is disqualified from being a member of the cabinet.

Hence, legal experts had raised questions over the legality of his appointment on November 17.

Speaking on the matter, President’s Office spokesperson Ibrahim Hoodh said that Imran had resigned “on his own accord”.

He added that the President’s Office believes that Imran’s first appointment was legal as well.
