The High Court has commenced hearings on an appeal filed by the State following the release of a suspect accused of attempting to smuggle drugs into Maafushi Prison using a drone.
The items were seized during an operation conducted at approximately 12:45 a.m. on the night of May 24. The operation was carried out through a joint effort between Maafushi Prison, the Maafushi Police Station, and Counter-Narcotics Intelligence.
During the operation, police seized five rubber packets containing substances suspected to be narcotics. The items have a preliminary weight of 395.92 grams.
Police had previously arrested an individual named Mohamed Khabil Khalid in connection with this case.
The state is appealing a court order issued by the Maafushi Magistrate Court following a third request by the police to remand the suspect with additional evidence. The court had instead ordered his release under specific conditions.
The state has appealed the decision in the High Court, noting that another individual is also under suspicion in this case. The suspect has been identified as a native of M. Mulah.
The state alleges that they acted in collusion to engage in the trafficking of illicit narcotics.
The state submitted two primary points of appeal to the High Court regarding this case. One of these points contended that the judge's decision was reached in violation of the established principle requiring a clear statement of the legal reasoning and grounds upon which a judicial ruling is based.
The case is being presided over by a High Court bench consisting of Judge Huzaifa Mohamed, Judge Hussain Mazeed, and Judge Mohamed Shaneez Abdulla.
