Majlis approves dismissal of Judge Faiz

Judge Hussain Faiz Rashad, who has been suspended by the Criminal Court

The People’s Majlis has approved the dismissal of Criminal Court Judge Hussain Faiz Rashad from his position.

The decision follows a review prompted by a letter from the Judicial Service Commission (JSC), with the Majlis Judiciary Committee overseeing the evaluation of the case.

According to JSC, a case was submitted alleging that Judge Faiz acted contrary to the Constitution and laws when ordering the release of Ali Anwar Mohamed, 41 of S. Hithadhoo / Cozy Corner, who was under police suspicion.

JSC stated that its investigative committee determined that Judge Faiz had violated the Constitution and laws in deciding on Ali Anwar’s detention.

During a Judiciary Committee meeting on Tuesday, members reviewed JSC’s report and held discussions on the appropriate course of action.

The committee, by unanimous agreement of the members present, decided to forward the matter to the whole house for consideration of Judge Faiz’s dismissal.

On Wednesday, the committee’s report was presented to the Majlis floor, and a vote was taken.

The parliament approved Judge Faiz’s dismissal with a majority of 56 lawmakers, while eight lawmakers voted against the measure.

Judge Faiz is currently under suspension in connection with the allegations. He was suspended for 60 days, the maximum period allowed for a judge, beginning last month.

This is the second suspension of Judge Faiz. His first suspension occurred in November 2021, following the leak of an audio recording alleging that the judges presiding over the case against former President Abdulla Yameen Abdul Gayoom were “held hostage.”

Although the suspension at that time was set for 60 days, JSC revoked it approximately one month later.

The repeated suspensions and now dismissal of Judge Faiz highlight ongoing scrutiny over judicial conduct and the accountability mechanisms enforced by JSC and the parliament.
