The case seeking the dismissal of Criminal Court Judge Hussain Faiz Rashad has been forwarded to the People’s Majlis Judiciary Committee for review.
A letter from the Judicial Service Commission (JSC) detailing the matter was read during Monday’s parliamentary sitting.
According to the letter, the commission received a case alleging that Faiz acted in violation of the Constitution and laws when he ordered the release of Ali Anwar Mohamed, 41, of S. Hithadhoo / Cozy Corner, an individual police suspect to be a major drug trafficker.
JSC stated that it investigated the matter as a disciplinary case. The letter noted that the Commission’s Complaints Committee found Faiz had acted contrary to the Constitution, the Judges Act, and the Code of Conduct for Judges in relation to the release order. As a result, the commission has asked the parliament to dismiss him from his position.
Judge Faiz is currently under suspension in connection with the issue. He was suspended last month for 60 days, the maximum period a judge can be suspended.
This is the second suspension for Faiz. He was previously suspended in November 2021 after the leak of an audio recording alleging that judges presiding over former President Abdulla Yameen’s case were “held hostage.”
Although he was suspended for 60 days at the time, JSC lifted that suspension after about a month.
