Supreme Court dismissed Judge late on Thursday

Maldivian Democratic Party (MDP) on Sunday, said the dismissal of Civil Court Judge Maryam Waheed’s dismissal from her position was a warning delivered to all Judges.

A statement released by the Party on the dismissal of the Judge said the dismissal was an unprecedented move in the nation’s history. MDP said the move was not a characteristic of civilized society that prides on justice. MDP said the decision was against the Constitution, international conventions and agreements.

The Supreme Court announced the decision stating that this was in connection to the Civil Court case on V. Bodumohoraa.

MDP noted six points in connection to the dismissal. The Party noted that no investigation as carried out on the Judge’s conduct. Additionally, they note that Judicial Service Commission (JSC) is tasked with affairs of Judges and the Commission had no part in decision. MDP added that the decision was taken without the input from Parliament as well.

MDP noted that the State had revoked their appeal and initial case sent to High Court over the lower Court’s decision.

Judge Maryam Waheed had made a ruling over Bodumora Island in Vaavu atoll saying that the government must sign an agreement on its development within seven days of her verdict.

The Supreme Court’s ruling on Thursday maintained that the government is under no obligation to sign it and that it is optional. The Court had ruled that Judge Waheed cannot preside in any court in the country. This is the first time the Supreme Court had enacted a penalty on Judge over a verdict.
