Judicial Service Commisison (JSC)’s report on the Supreme Court has been sent to the parliament floor.
The report highlights 17 of the Supreme Court’s actions that had violated the Constitution and laws.
These decisions are:
- The Supreme Court taking charging of judicial administration after nullifying Article 21(e) of the Judicial Service Commission Act,
- Nullifying articles 82 to 94 in chapter 8 of the Judicature Act,
- Taking charge of regulating the work of lawyers,
- Barring lawyers from representing clients in Maldives courts,
- Reducing the deadline for appeals,
- Nullifying JSC’s authority and drafting its own guidelines to transfer lower court judges,
- Suspending judges against JSC’s regulation,
- Finding Elections Commission chief Fuad Thaufeeq and deputy chief Ahmed Fayaz Hassan guilty of criminal charges and dismissing them,
- Nullifying the powers of the human rights commission by setting their own guidelines for the commission,
- Ordering JSC to stop evaluating judges and obstructing the commission’s work,
- Requiring the Supreme Court’s approval before implementing any no-confidence motion passed in parliament,
- Nullifying the parliament’s decision to dismiss former Civil Service Commission chief Mohamed Fahmy Hassan,
- Nullifying parts of its own order issued on February 1, 2018, and
- Setting administrative rules and regulations to the lower courts and its judges.
After the report was sent to the floor, Speaker Mohamed Nasheed said that the Supreme Court had overstepped its bounds and undermined the Constitution.
During the debates, MPs highlighted other violations that the Supreme Court committed.
The report has been sent to the judiciary committee for review.
