Transparency Maldives has urged authorities to conduct a fair and independent investigation into the death of Adam Athuhar, who killed himself while in police custody.

The anti-corruption watchdog issued the press release jointly with A Coalition for Integrity, Association for Democracy in the Maldives and the Mental Health Support Group of Maldives on Monday, calling for a fair and independent Investigation into the arrest and death of Athuhar.

Athuhar was arrested and remanded for taking a woman hostage, threatening and assaulting her at knifepoint.

Expressing deep concern regarding the circumstances leading to the death of Athuhar who was placed in the custody of the Maldives Police Service and passed away while receiving treatment at Indhira Gandhi Memorial Hospital (IGMH), TM extended condolences to the mourning family.

TM has urged all relevant authorities including the Human Rights Commission of Maldives (HRCM) and National Integrity Commission (NIC) to conduct a fair, independent, thorough, and transparent investigation into the circumstances surrounding his arrest and the events leading up to his death.

Shedding light on the evident use of force by an officer during his arrest as well as the decision to place Athuhar in remand given his health and medical condition, the anti-corruption watchdog urged to thoroughly investigate this incident.

In addition to this, TM called on investigative bodies to ensure that the investigation is conducted in a manner that is respectful and considerate to the family of the deceased.

TM has reiterated and called to expedite and conduct the probe in an open and transparent manner and publicize the findings of the investigation.

In its call for systemic change, TM highlighted the need for rigorous oversight, enhanced governance, and improved support services for detainees.

TM's call to improve oversight mechanisms in custodial and detention systems underscores a pressing need for regular monitoring and evaluation of detention facilities.

The anti-corruption watchdog advocates for a comprehensive review of current conditions and the treatment of detainees to ensure that facilities are not only meeting minimum standards but are also fostering an environment conducive to meaningful reform.

Key to TM’s recommendations is the enhancement of governance mechanisms and management structures within detention facilities.

This includes the establishment of transparent processes for monitoring performance and conditions, as well as the implementation of robust accountability measures. By improving oversight, the aim is to create an environment where detainees' rights are consistently upheld, and their well-being is actively safeguarded, according to TM.

One of TM’s pivotal recommendations in its statement is investment in public health care systems to provide universal mental health support.

This initiative is crucial for addressing the needs of individuals living with mental health conditions and substance-use disorders.

TM emphasized the importance of effective coordination between the criminal justice system and health and social services to prevent the unnecessary incarceration of individuals struggling with these issues.

By ensuring that mental health support is both available and accessible, TM aims to reduce the disparities in care and promote alternative approaches to incarceration. This includes exploring options such as diversion programs that direct individuals to appropriate treatment rather than criminal justice pathways, thereby addressing underlying issues and potentially reducing recidivism.
