High Court orders authorities to transfer Adeeb to house arrest

High Court has ordered authorities to transfer ailing former Vice President Ahmed Adeeb to house arrest.

The court at a hearing on Monday ordered Adeeb to be kept under house arrest until it gives a verdict on Adeeb’s appeal.

The appeal is regarding Adeeb seeking medical leave abroad due to his deteriorating health. The request had been denied by the Civil Court, which stated that Adeeb had failed to complete the administrative procedures before making the request.

At High Court’s appeal hearing on Sunday, Adeeb’s lawyer Mohamed Ismail said that he is now at a point that his health is threatening his life and asked that the court allow him to be kept at home, as recommended by doctors, until it gives a verdict on permitting him abroad for treatment.

RaajjeMV understands that on Monday’s hearing, the state failed to provide a compelling reason to keep Adeeb in prison despite his ill health.

At Sunday’s hearing, Adeeb’s lawyer Ismail said that while the Civil Court rejected their request after claiming that they had failed to complete the administrative procedures, the procedures should have been completed by the state, as Adeeb would be unable to do so until the correctional service gives him his medical documents, which are in their custody.

He also said thatAdeeb's lawyers told the Civil Court that it was citing nonexistent regulations when it gave its verdict, and that afterwards the judges had made changes to its verdict, which he added is unlawful. Due to these issues, lawyer Ismail asked the High Court to nullify the Civil Court’s verdict and order the state to send Adeeb abroad for treatment.

In response, the state attorney said that the Civil Court rejected Adeeb’s request because he failed to cooperate with the authorities by refusing to undergo a CT scan proposed by the correctional service.

The attorney stated that the High Court cannot issue an order to send Adeeb abroad since the Civil Court gave its verdict on procedural grounds.

The attorney defended the Civil Court’s mistake of citing nonexistent regulations by saying that it was an administrative error and therefore the court has the authority to make the necessary changes.

A three-judge bench is looking into Adeeb’s appeal case. They are High Court chief judge Shujau Usman, judge Hassan Ali, and judge Hussain Shaheed.
